How to Respond to a Parking Letter Before Claim

August 21, 2023

A Letter Before Claim (also known as a Letter of Claim or Pre-Action Protocol Letter) is the final, formal warning issued by a parking operator’s solicitors (such as Gladstones Solicitors, DCB Legal, BW Legal, or Overdales) before issuing a County Court claim (N1 Form).

Receiving a Letter Before Claim means the matter has escalated past general debt collectors. However, pre-action rules strictly govern how both parties must exchange information before a court claim can be issued.

Under the Practice Direction – Pre-Action Conduct and Protocols and the Pre-Action Protocol for Debt Claims, you have a formal 30-day window to respond, deny the debt, and demand full documentary disclosure.

1. What Is a Pre-Action Letter Before Claim?

A Letter Before Claim is a formal legal notice sent pursuant to paragraph 3 of the Practice Direction – Pre-Action Conduct and Protocols. Its purpose is to allow parties to understand each other’s positions, exchange key evidence, and avoid unnecessary court proceedings.

Unlike automated debt collection letters, ignoring a Letter Before Claim is risky. If you do not respond, the solicitor can file a court claim at the Civil National Business Centre (CNBC), and the court may treat your silence as unreasonable conduct when awarding legal costs under CPR 27.14(2)(g).

2. Key Elements of Parking Pre-Action Response

When responding to solicitors like Gladstones or DCB Legal, do not write an informal or emotional email. A pre-action response must be structured around civil procedure rules and statutory consumer protections:

A. Formal Denial of Debt & Driver Identity Protection

State clearly that the registered keeper denies the alleged debt in full. Put the claimant to strict proof regarding every element of their cause of action. Make no admission as to who was driving the vehicle, and explicitly refuse to identify the driver. Under Schedule 4 of the Protection of Freedoms Act (POFA) 2012, there is no automatic legal presumption that the registered keeper was the driver.

B. Challenge Pre-Action Deficiencies & Unparticularised Sums

Private parking solicitors frequently send “composite” or vague demand letters that bundle multiple alleged parking events or fail to state the precise location, arrival/departure timestamps, or specific contractual terms breached. Point out that a vague demand fails paragraphs 3–6 of the Practice Direction on Pre-Action Conduct.

C. Strike Out Debt Recovery & Solicitor Surcharges

Solicitors often inflate the claim by adding £60 to £70 in “debt collection costs” or unparticularised legal fees, bringing a £100 ticket up to £170 or £340 for multiple notices.

  • POFA 2012 Schedule 4, Paragraph 4(5): Strictly caps maximum keeper recovery to the unpaid charge specified on a compliant Notice to Keeper.
  • Consumer Rights Act 2015 (Sections 62 & 71): Requires all contractual terms and added fees to be prominent, transparent, and fair. The court has a statutory duty under section 71 to consider fairness on its own motion.
  • Distinguishing ParkingEye v Beavis [2015]: Clarify that Beavis turned on its specific facts (an £85 charge with clear, prominent signage) and is not judicial authority for the automatic recovery of inflated, unproven solicitor additions.

D. Demand Mandatory Document Disclosure (14-Day Notice)

Under pre-action conduct rules, you are entitled to request the core evidence required to understand their claim. Require the solicitor to provide the following within 14 days before taking any court action:

  1. Notice Copies: Full unredacted copies of every Notice to Driver (NtD) and Notice to Keeper (NtK) relied upon, including proof of posting and delivery evidence.
  2. ANPR & Event Audit: Exact dates, timestamps, and full-resolution entry/exit ANPR images alongside camera calibration and synchronisation logs.
  3. Signage Evidence: Dated, contemporaneous photographs of all entrance, tariff, and terms signs in place on the material date, alongside a site layout map showing their exact positions.
  4. Landowner Authority: An unredacted copy of the contemporaneous landowner contract or chain of authority proving the parking firm has standing to offer parking, enter contracts in its own name, issue charges, and initiate legal proceedings on that specific land.
  5. Itemised Breakdown: A complete calculation showing the original parking charge, every added fee, the contractual or statutory basis for each sum, and proof that each cost was actually incurred.
  6. DVLA KADOE Audit: Evidence of DVLA registered-keeper requests, stating the reasonable cause relied upon and proof of data-processing compliance.

3. Step-by-Step Action Plan

  1. Calculate Your Response Window: You have 30 days from the date of the solicitor’s letter to respond under Pre-Action Protocol guidelines.
  2. Draft a Formal Dispute Representation: Adapt the pre-action framework to incorporate your case references, vehicle registration, and specific defenses (e.g., unserved notices, unlit signs, or payment receipts).
  3. Send via Recorded Delivery or Email: Email the response directly to the solicitor’s dedicated pre-action email address or send via Royal Mail Signed For.
  4. Retain Written Proof: Keep copies of your email, sending confirmations, postal receipts, and delivered logs.
  5. Monitor for Disclosure: Require the solicitor to place the claim on hold pending full disclosure. Issuing court proceedings without responding to a pre-action disclosure request constitutes unreasonable conduct under CPR 27.14(2)(g).

5. Frequently Asked Questions (FAQ)

1. What happens if I ignore a Letter Before Claim?

Ignoring a Letter Before Claim gives the solicitor a green light to issue a County Court claim form (N1) through the Civil National Business Centre. Failing to engage pre-action prevents you from requesting early evidence disclosure and may result in adverse court cost orders under Civil Procedure Rule (CPR) 27.14 for acting unreasonably.

2. Can debt recovery agents send bailiffs to my house?

No. Debt collection agents and parking solicitors are not court bailiffs. Bailiffs can only be appointed if a parking company sues you in the County Court, a judge issues a County Court Judgment (CCJ) against you, and you fail to pay the ordered sum within the court-mandated deadline.

3. Will receiving a debt recovery notice or Letter Before Claim ruin my credit rating?

No. A debt recovery demand or pre-action letter has zero effect on your credit score. Private parking tickets do not appear on credit files unless the operator takes court action, wins a financial judgment, and you fail to pay it within 30 days of the court order.

4. Can Gladstones, DCB Legal, or debt collectors legally add £60–£70 in extra fees?

While operators and solicitors routinely add these sums to their letters, they are frequently struck out by District Judges in court. Under POFA 2012, Schedule 4, Paragraph 4(5), a parking firm cannot recover more from a registered keeper than the unpaid charge stated on the original Notice to Keeper. You should explicitly challenge these added fees as unrecoverable double recovery under the Consumer Rights Act 2015.

5. Do solicitors have to put the case on hold while they respond to my pre-action letter?

Yes. Paragraph 4 of the Practice Direction on Pre-Action Conduct requires parties to act reasonably and exchange information to see if litigation can be avoided. If you submit a detailed pre-action response requesting core documents, the claimant’s solicitors should place the file on hold while they compile and disclose the requested evidence bundle.

6. What if I didn’t receive the original PCN because I moved home or there was a postal loss?

If you did not receive prior notices through no fault of your own, Clause 10.2 of the Single Code of Practice dictates that upon discovering your current address, the operator or debt agency must offer you an opportunity to appeal or pay at the original rate. You should submit a formal dispute stating you had no prior knowledge and demand a restored 28-day appeal window.

7. What should I do if a debt collection agency calls my phone?

Do not discuss the details over the phone. Debt collection agents use phone calls to extract admissions regarding who was driving. Politely inform them that the debt is formally disputed in writing under Code Clause 11.2 and request that all further communication be conducted exclusively via post or email.

8. What if I genuinely paid for parking or entered the wrong registration?

If you paid for parking or made a keying error when entering your vehicle registration mark (VRM), gather your payment receipt, banking screenshot, or app log. Under the Single Code of Practice Appeals Charter, minor keying errors must be cancelled, and major keying errors or evidenced payment must result in cancellation or a capped £20 settlement.
